Terms of Use
These Terms of Use (“Terms”) are the contract between you and Filamantra s.r.o. for using SUBMERG3D — this website, Partbase, downloads, Build Assistant, software packages, and Builder’s Membership.
By creating an account, buying a membership, or downloading files, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
1. Who we are

SUBMERG3D and Anty Beobachtung are projects operated by Filamantra s.r.o. (“we”, “us”, “our”). You (“you”, “user”) are the person using the site or buying access.
These Terms are a distance contract for digital content and online services under Czech and EU consumer law.
2. The service
SUBMERG3D is a documentation and download platform for building the E/Xplorer AUV and related software. It includes:
- public pages about the craft and software;
- Partbase (parts, buying notes, and documentation);
- account registration and login;
- free 3D files and other free downloads (login required);
- Build Assistant (guided build steps);
- paid Builder’s Membership files and software;
- links to related tools such as Dolphin Cloud at cloud.submerg3d.eu.
We may add, change, or withdraw files, documentation, and features. STL files are the production files for 3D printing. Blender files, where provided, are for reference and assembly help only — use the STLs to print.
Third-party shops, component links, and other websites are not part of our service. Their terms and prices apply to those purchases.
3. Accounts
You must be at least 16 years old to create an account. If you use the service for a company, you confirm you are allowed to bind that company.
You must give accurate details, confirm your email, and keep your password secret. You are responsible for activity on your account. Tell us if you think someone else is using it.
We may suspend or close an account if these Terms are broken, if payment fails or is reversed, or if we must do so for security or legal reasons. You may ask us to close your account by emailing andrej@filamantra.cz.
Closing an account does not automatically refund a membership already used to download paid digital content. Statutory consumer rights still apply where they must.
4. Licence to files and software
We own, or are allowed to licence, the 3D models, documentation, firmware, and software we publish. Downloading does not transfer ownership. We grant you a limited, non-exclusive, non-transferable licence, as follows.
What you may do
- download files you are allowed to access (free files while logged in; paid files with a valid membership);
- use them to 3D-print, assemble, and operate a craft for your own personal, non-commercial hobby or educational use;
- use the control software and related tools on hardware you own, for that same personal use;
- keep copies for backup and for building your own craft.
What you may not do
- share, sell, rent, or publicly upload our original files, archives, or source;
- publish paid software, Blender assemblies, or membership-only packages;
- sublicence the files or grant access through a shared account;
- use the files to manufacture and sell crafts, kits, or parts as a business, unless we agree in writing (see Developer access);
- remove copyright or credit notices;
- present our designs as your original commercial product.
You may show your own printed and assembled craft (photos, video, write-ups). Please credit SUBMERG3D / E/Xplorer where it is reasonable.
Open-source or third-party components bundled with our software remain under their own licences. Those licences apply in addition to these Terms.
5. Builder’s Membership and payments
Free access covers the files and Build Assistant features we mark as free. A Builder’s Membership is a one-time payment that unlocks paid files and software for your account on this site — currently USD 49.00 unless a different price is shown at checkout.
Membership is tied to your account. It is not a subscription and it is not a transfer of copyright. It does not include Developer source files unless we sell those separately.
Prices are in euro. If VAT applies, it is handled according to EU VAT rules for digital services (including the invoice details you give us). Checkout is processed by Stripe. We never see your full card number.
Access to paid downloads lasts for as long as we operate this service and your account stays in good standing. We may update files over time. We do not promise that every historical file will remain available forever.
“Online build support” means reasonable help through the channels we offer (for example email or documentation). It is not a 24/7 helpdesk and it is not a guarantee that your particular printer, electronics, or build will succeed.
6. Withdrawal and refunds
If you are a consumer in the EU/EEA, you normally have 14 days to withdraw from a distance contract without giving a reason (Directive 2011/83/EU, as implemented in Czech law).
Builder’s Membership is digital content supplied online, not on a disc or other physical medium. Under Article 16(m) of that Directive, the 14-day right of withdrawal is lost once performance has begun, if you asked for immediate access and acknowledged that you would lose the right to withdraw.
By completing checkout you ask us to provide the digital content immediately. If you then download or otherwise access paid files, you lose the 14-day withdrawal right for that purchase. If you have not yet accessed any paid content, you may still withdraw within 14 days by emailing andrej@filamantra.cz with your account email and order details.
This does not affect your mandatory rights if the digital content is not in conformity with the contract (defective or incomplete files we are responsible for). Tell us and we will repair, replace, or otherwise remedy the problem as the law requires.
Chargebacks used in bad faith after you have downloaded paid files may lead to account suspension.
7. Safety and your responsibility
E/Xplorer is a DIY robotic submarine project. It is not a certified vessel, not a toy, and not for carrying people. Building and running it involves electricity, batteries, motors, heat, pressure, and water. Mistakes can cause fire, flooding, injury, property damage, or loss of the craft.
You build, test, and operate at your own risk. You must:
- follow local law for watercraft, radio, and drones or unmanned systems;
- use safe battery handling and charging practice;
- pressure-test and leak-test before any real dive;
- keep people, animals, and property clear of propellers and moving parts;
- not use the craft where it could endanger others or protected areas.
Documentation, print settings, and “best we know” notes are guidance from our own builds. Printers, materials, and parts vary. You are responsible for checking fit, strength, waterproofing, and electronics before you rely on them.
We are not liable for how you use a finished craft, for failed prints, or for third-party components you buy.
8. Acceptable use
You must not:
- try to bypass login, membership, or download controls;
- scrape or bulk-harvest files in a way that harms the service;
- share your password or sell access to your account;
- upload malware or attack the site;
- use the service for anything unlawful.
We log downloads (including IP address) to enforce access rules, as described in the Privacy Policy.
9. Our intellectual property
The SUBMERG3D name, E/Xplorer designs, site content, documentation, and original 3D and software files are protected by copyright and other IP rights. Except for the licence in section 4, we reserve all rights.
Feedback you send us may be used to improve the project without paying you a fee. You still own your own photos and build logs.
10. Warranty and liability
We provide the site and files with reasonable care. Hobby documentation and 3D models are offered as practical help, not as a professional engineering certification.
If you are a consumer, nothing in these Terms limits your mandatory statutory rights, including rights for digital content that is not in conformity with the contract.
To the extent allowed by law, we are not liable for:
- indirect or consequential loss (lost time, failed prints, lost craft, lost data);
- loss caused by your modifications, wrong materials, or third-party parts;
- outages of Stripe, hosting, or other providers we do not control.
We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any liability that Czech or EU law does not allow to be limited.
If a limit is allowed, our total liability for a paid membership is limited to the amount you paid us for that membership.
11. Developer access
Source 3D objects and software source, where offered, are a separate Developer arrangement. They are not included in the standard Builder’s Membership. Contact us if you need that licence. Until we agree in writing, section 4 still applies.
12. Changes and availability
We may update these Terms. The date at the top will change. Continued use after an update means you accept the new Terms, except where consumer law requires a different process for a paid contract.
We aim to keep the site available but we do not guarantee unbroken uptime. We may take the service down for maintenance or if we stop the project. If we permanently discontinue paid downloads and you are a consumer who has not been able to obtain the paid content, contact us and we will handle it under applicable law.
13. Governing law and disputes
These Terms are governed by the law of the Czech Republic, without affecting mandatory consumer protections of your country of residence in the EU/EEA.
Courts of the Czech Republic have jurisdiction, except that an EU/EEA consumer may also bring proceedings in the courts of their country of residence. We may sue in your country of residence as well.
You may also use out-of-court consumer dispute resolution where it applies, including the Czech Trade Inspection Authority (Česká obchodní inspekce, coi.cz).
